2. Purpose

These General Terms and Conditions (the “Terms”) apply to all travel services offered by The Sangha Project Co. (hereinafter “the Company”), whether tailor-made trips or organized group tours. Any booking implies full and unconditional acceptance of these Terms by the Client.

Certain group trips are accompanied by a Group Leader, who acts under a separate service agreement concluded with the Company (see Article 3).

3. Role of the Accompanying Group Leader

When a group trip is accompanied by a Group Leader, the latter acts as an independent service provider to the Company, under a separate service agreement. The Group Leader is not a party to this contract concluded between the Company and the Client, and is not responsible for organizing or performing the travel services, which remain the exclusive responsibility of the Company and its local service providers, in accordance with Article 9.

4. Booking and Conclusion of the Contract

A booking becomes final when:

the registration form has been duly completed and signed;
the deposit has been paid;
these General Terms and Conditions have been accepted.

The Company reserves the right to refuse a booking if the Client’s behavior is likely to disrupt the smooth running of the trip or the safety of the group.

5. Quotes and Pricing

All quotes are valid for 7 days. Any quote not confirmed within this period will be adjusted, and bookings may be modified subject to availability. We recommend confirming your quote promptly to secure the price and services indicated.

Possible revisions: the price may be revised if the change results directly from variations in:

passenger transport costs linked to fuel or other energy sources;
the level of taxes or fees (airport, port, tourist, etc.);
the exchange rate between the local currency and the euro.

6. Payment

Deposit: 40% of the total amount due at booking.
Balance: due no later than 60 days before departure.
Bookings made less than 30 days before departure: full payment due at booking.

Prices are quoted in euros or Indian rupees and may be adjusted in accordance with Article 5.

Payments may be made by bank transfer, credit card, or approved payment gateways. Transaction fees are borne by the Client.

7. Changes to the Itinerary

The Company undertakes to provide the announced program but may, if necessary (safety, local conditions, force majeure — pandemics, natural disasters, government travel bans, etc.), modify itineraries, accommodations, or services.

Before departure: the Client will be informed, as far as possible, at least 7 days in advance.
After departure: any change will be communicated within a reasonable time.

Replacement of the Group Leader or a local guide/escort

The Company may need to replace the Group Leader or any local guide/escort originally assigned, particularly where the latter is unable to travel (illness, accident, withdrawal), with an equivalent professional. Such a replacement does not constitute a material change to the trip and does not entitle the Client to a refund under Article 8.A. A Client who does not wish to maintain their participation in such a case may cancel their booking under the conditions set out in Article 8.B.

8. Cancellation

A. Cancellation by the Company

Non-payment: automatic cancellation with no refund of the deposit.
Minimum number of participants not reached (group trips): possible cancellation up to 12 weeks before departure, with a full refund (less bank fees and any transport costs already incurred).
Exceptional cases (force majeure, death or serious accident of a team member): full refund.

B. Cancellation by the Client — Tailor-Made Trips

More than 90 days before departure: full refund (less bank fees and excluding airfare costs).
90 to 60 days: 30% withheld.
60 to 30 days: 50% withheld.
30 to 14 days: 80% withheld.
Less than 14 days: 100% withheld.

Organized Group Trips

More than 90 days before departure: refund of all amounts paid, less the cost of any domestic flights already issued and bank/transaction fees.
90 to 30 days: 40% withheld (deposit).
30 to 14 days: 60% withheld.
Less than 14 days: 100% withheld.

Bank and exchange fees are borne by the Client. Refunds (where applicable) will be made within 14 business days, using the original payment method unless otherwise agreed.

9. Liability

The Company acts as a tour organizer and carefully selects its service providers (hotels, transport, guides). However, its liability cannot be engaged in the following cases:

loss or theft of issued tickets;
failure to present valid identification or health documents (passport, visa, vaccination certificates, etc.);
incidents caused by unforeseeable and unavoidable third parties: wars, political unrest, strikes, riots, bankruptcy of a service provider, flight cancellation, congestion, adverse weather, breakdowns, loss or theft of luggage;
delays or itinerary changes resulting from such events, which do not entitle the Client to compensation.

If an itinerary becomes unfeasible, the Company will use the funds already committed but not yet spent to propose an alternative itinerary. If this new itinerary results in additional costs, these will be borne by the Client. Refusal of this adjustment will be treated as a cancellation (see Article 8).

Limitation of Liability

Without prejudice to the exclusions listed above, the Company’s total liability under this contract, for all damages combined, shall not exceed the total amount actually paid by the Client for the trip concerned.

10. Client Insurance and Emergency Information

The Client must provide proof of insurance before departure covering at minimum:

medical and hospitalization expenses;
repatriation assistance;
baggage insurance;
trip cancellation and interruption.

The Company disclaims any liability if the Client fails to take out such insurance. The Client certifies being fit to participate in the chosen program. Any medical condition must be disclosed in advance. The Company reserves the right to refuse participation if safety is at risk.

No later than 30 days before departure, the Client undertakes to provide the Company with: proof of their travel insurance specifying the insurer, policy number, and the insurer’s assistance/emergency contact details; as well as the contact details of a person to be reached in case of emergency (name, relationship to the Client, phone number, email). This information enables the Company to contact the Client’s insurer and/or the designated person directly in the event of an accident, serious illness, or any emergency situation, under the conditions set out in Article 11.

11. Emergency Management

In the event of an accident, serious illness, or any emergency affecting the Client, the Company undertakes to:

(a) promptly make the necessary operational decisions (emergency transport, evacuation, hospitalization), in coordination with its local service providers;
(b) contact the Client’s insurer directly using the information provided under Article 10, and advance, up to a limit of €300, urgent medical or evacuation expenses not immediately covered by the insurance;
(c) promptly inform the emergency contact designated by the Client under Article 10, as well as the Group Leader accompanying the group, if applicable.

For each trip, the Company designates a local point of contact available 24/7 throughout the stay, whose contact details are provided to the Client before departure.

12. Client Responsibility

Clients agree to comply with local laws, customs, and the instructions of guides. The Company reserves the right to exclude any participant whose behavior jeopardizes the safety or smooth running of the trip, without compensation.

13. Photography and Use of Image

The Company and/or the accompanying Group Leader may take photographs or videos of the group during the trip, which may be used for communication and promotional purposes (website, social media, marketing materials).

A Client who does not wish to appear in such materials must notify the Company in writing before departure. In the absence of written objection, the Client’s participation in such filming/photography is deemed accepted.

14. Minors

Minor participants are only accepted if accompanied by a responsible adult and subject to the Company’s prior approval, as well as the signing of a parental or legal guardian authorization.

15. Personal Data

The information collected (name, contact details, passport, travel preferences, insurance information and emergency contact details referred to in Article 10) is necessary for processing the booking and organizing the trip. This data may be stored outside the EU. By accepting these Terms, the Client consents to such transfer in accordance with the GDPR. It is used exclusively by the Company and its local partners for the performance of the contract.

This data is retained for a period not exceeding 6 months after the end of the trip, unless a longer retention period is legally required, and is then deleted or anonymized.

The Client has the right to access, rectify, and delete their data by sending a request to: contact@thesanghaproject.com.

16. Governing Law and Jurisdiction

This contract is governed by Indian law. Any claim must be made in writing within 15 days after the end of the trip. After this period, no claim will be accepted.

In the event of a dispute, the parties will endeavor to reach an amicable resolution before any legal action. Failing this, any dispute relating to the performance or interpretation of these Terms shall be brought before the competent courts of Vadodara, Gujarat, India.
